This Privacy Policy describes how TopProperty LLC (“TopProperty,” “we,” “us,” or “our”) collects, uses, and shares information about you when you use our website fixapply.com and related services (the “Services”). FixApply is a brand operated by TopProperty LLC.

By using the Services, you agree to the practices described in this Policy. If you do not agree, please do not use the Services.


1. Who We Are

TopProperty LLC, doing business as FixApply, operates an online marketplace that connects homeowners in South Florida with vetted local home-service professionals (handymen, painters, electricians, plumbers, contractors, etc.). Our AI consultation tools help users describe projects, understand realistic pricing, and get matched with the right pro.

2. Information We Collect

We collect information you provide directly, information collected automatically, and information from third parties.

2.1 Information you provide

  • Identifiers: name, email address, phone number, postal address (including street, city, state, ZIP).
  • Account credentials: username, password (hashed), social-login identifiers if you sign in with Google or Facebook.
  • Project details: the description of work you submit (“Get Estimate” requests), category selected, photos you upload, estimated hours, preferred start date, budget if provided.
  • Communications: messages exchanged with us or with matched service professionals through the platform; survey or feedback responses.

2.2 Information collected automatically

  • Device & browser data: IP address, user-agent string, operating system, browser type and version, referring URL, pages viewed, timestamps.
  • Cookies and similar technologies: see Section 7.
  • Geolocation: if you click the “Use my current location” button when filling out a request form, we receive precise GPS coordinates from your browser. You may decline this in your browser. We otherwise derive approximate location from your IP address and from the postal address you provide.
  • Analytics: Google Analytics and Google Site Kit collect usage statistics; Meta (Facebook) Pixel collects events for advertising attribution.

2.3 Information from third parties

  • Social-login providers (Google, Facebook): if you sign in via these services, we receive your name, email, and profile photo as authorized by you.
  • Geocoding service (OpenStreetMap / Nominatim): we send your address to convert it to latitude/longitude for displaying location pins; we do not send your name, email, or any other personal identifier.
  • Spam-detection services (e.g., Akismet, WPForms anti-spam) may receive comment metadata.

3. How We Use Information

We use your information to:

  • Provide and operate the Services, including creating your account and processing your project requests.
  • Match your request with qualified service professionals. When you submit a request, we share the contents of your request with up to four matched professionals so they can contact you with offers.
  • Communicate with you about your project, account, support inquiries, and service updates by email, phone, or SMS (see Section 5).
  • Improve our AI matching, pricing models, and overall user experience.
  • Detect, prevent, and address fraud, security issues, and abuse.
  • Comply with applicable laws, regulations, and legal process.

We will not sell your personal information to data brokers. We do not share your information with third parties for their own independent marketing purposes.


4. How We Share Information

We share your information only as described below.

4.1 Matched service professionals (vendors)

When you submit a request, the description, photos, address, preferred timing, and contact information you provide are shared with up to four service professionals matched to your job. These vendors are independent contractors and process your information under their own privacy practices. We require vendors to use your data solely to respond to your request, but we are not responsible for their compliance.

4.3 Legal and safety

We may disclose information if required by law, court order, subpoena, or to protect our rights, safety, or property, or that of our users or the public.

4.4 Business transfers

If TopProperty LLC is acquired, merged, or undergoes asset sale, your information may be transferred as part of that transaction. We will notify you and offer choices where required by law.


5. SMS, Phone Calls, and TCPA Consent

By submitting a request through our Get-Estimate form and ticking the consent checkbox, you give your express written consent under the federal Telephone Consumer Protection Act (TCPA) for TopProperty LLC and up to four matched service professionals to contact you by:

  • Phone calls (including automated/prerecorded calls),
  • SMS / text messages (including autodialed messages),

at the phone number you provided.

Message frequency: typically 2–6 messages per request, plus optional reminders.

Message & data rates: may apply, depending on your wireless carrier plan.

To opt out at any time: reply STOP to any SMS we send, or email us at mail@fixapply.com. After you opt out, you may still receive one confirmation message.

For help: reply HELP or contact us at the email/phone above.

Consent is not a condition of purchase. You may use the Services without giving consent, but in that case we cannot pass your request to vendors who will contact you.


6. Your Rights

6.1 All users

Regardless of where you live, you may:

  • Access the personal information we hold about you.
  • Correct inaccurate information in your account.
  • Delete your account and associated personal information (subject to retention obligations described in Section 9).
  • Withdraw consent for marketing communications at any time.

To exercise any of these rights, email mail@fixapply.com with your request. We will respond within 30 days.

6.2 California residents (CCPA / CPRA)

If you live in California, you have additional rights under the California Consumer Privacy Act:

  • Right to know: what categories of personal information we collect, the sources, the purposes, and the categories of third parties with whom we share it (all listed in Sections 2b��4 above).
  • Right to delete: request deletion of your personal information, subject to exceptions.
  • Right to correct: request correction of inaccurate personal information.
  • Right to opt out of “sale” or “sharing”: we do not sell your personal information or share it for cross-context behavioral advertising in the CCPA’s sense. We do use Meta Pixel for advertising — to opt out of this specific use, email us at mail@fixapply.com or use the browser-based opt-out tools at https://optout.aboutads.info/.
  • Right to non-discrimination: we will not deny you Services, charge different prices, or provide a different level of quality because you exercised these rights.

To submit a CCPA request, email mail@fixapply.com with the subject “CCPA Request.” We may verify your identity before fulfilling the request.

You may also designate an authorized agent to submit a request on your behalf.

6.3 EU / EEA / UK residents (GDPR)

If you live in the European Economic Area or the United Kingdom, you have rights under the GDPR / UK GDPR including access, rectification, erasure, restriction, portability, and objection. The legal bases on which we process your data are:

  • Consent (e.g., SMS consent, marketing emails) — Art. 6(1)(a).
  • Contract performance (delivering the Services you requested) — Art. 6(1)(b).
  • Legitimate interests (security, fraud prevention, analytics) — Art. 6(1)(f).
  • Legal obligations (tax, regulatory) — Art. 6(1)(c).

8. Children’s Privacy (COPPA)

The Services are not directed to children under 13. We do not knowingly collect personal information from children under 13. If we learn that we have collected information from a child under 13, we will delete it promptly. Parents or guardians who believe their child has provided us with personal information may contact us at mail@fixapply.com.


9. Data Retention

We retain personal information for as long as needed to provide the Services and as required by law:

  • Account information: until you request deletion, plus up to 30 days of soft-delete backup.
  • Request records: 36 months after the request is closed, for warranty, dispute, and tax purposes.
  • Marketing communications opt-in records: as long as you remain subscribed, plus a record of opt-out for legal proof.
  • Server logs and analytics: typically 14–26 months, then aggregated or deleted.

Anonymized and aggregated data may be retained indefinitely.


10. Data Security

We use industry-standard technical and organizational measures to protect personal information, including HTTPS/TLS encryption in transit, hashed passwords, role-based access controls, and regular security updates. No system is 100% secure, however, and we cannot guarantee absolute security. If we ever experience a data breach affecting your information, we will notify you and the appropriate authorities as required by law.


11. International Data Transfers

The Services are hosted in the United States. If you access them from outside the U.S., your information will be transferred to and processed in the U.S. and other countries where our service providers operate. By using the Services, you consent to these transfers. Where required, we use Standard Contractual Clauses or equivalent safeguards for transfers from the EU/UK.


12. Do Not Track Signals

Some browsers transmit “Do Not Track” (DNT) signals. We currently do not respond to DNT signals because no industry consensus exists on how to interpret them. You can still control tracking via the opt-outs described in Section 7.


13. Third-Party Links and Content

The Services may contain links to third-party websites. We are not responsible for the privacy practices of those sites. Please review their privacy policies separately.


14. Changes to This Policy

We may update this Policy from time to time. We will post the updated version on this page with a new “Last Updated” date. If changes are material, we will provide more prominent notice (e.g., by email or banner). Your continued use of the Services after the update constitutes acceptance of the revised Policy.


15. Governing Law and Dispute Resolution

This Policy and any dispute related to it are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws principles. Any dispute that cannot be resolved informally shall be brought exclusively in the state or federal courts located in Broward County, Florida.
